FAS Initiated Case against Angarsk Town Authority
OREANDA-NEWS. February 08, 2012. The Federal Antimonopoly Service (FAS Russia) initiated a case against Angarsk Town Authority and Angarsk Department for Housing & Utilities and Construction, actions of which can unreasonably prevent activities of other economic entities. It constitutes violations of Parts 1 and 3 Article 15 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.
Earlier, the Town Authority and the Department placed a municipal order to the works and services for landscaping, provision of urban amenities, maintenance of local highways, organization and maintenance of disposal sites for a municipal enterprise and an autonomous institution without organizing competitive bidding. Financing was provided through subsidies from a local budget.
According to FAS Russia, the order for the enterprise and a municipal assignment for the institution were put exclusively for municipal works, which must be placed in accordance with the law of the Russian Federation on procurement.
Article 15 of the Federal Law “On protection of Competition”, local self-government bodies and organizations that exercise the functions of the above bodies are prohibited to perform actions that lead or can lead to preventing, restricting, eliminating competition.
