OREANDA-NEWS. March 19, 2013. Under conditions of a moratorium or restricted land market an alternative with regards to the development of land relations in Ukraine should become leasing. This was informed in his statement for the Fifth annual forum “Agribusiness in Ukraine 2013” by the head of the State Agency of Land Resources of Ukraine Serhiy Tymchenko.

Besides, he told to the agrarian forum’s participants that by the Governmental bill “On the circulation of agricultural lands” being elaborated by the State Agency of Land Resources it is envisaged to fix a minimal term of land lease from 7 years.

“It is necessary to give an opportunity to buy a leasing right directly but not to realize contracts through corporative rights, it means to introduce free alienation lease. Nowadays the State Agency of Land Resources is initiating introduction of norms concerning restriction of volumes of lease of agricultural lands. For regulation of the mentioned relations acting norms of antimonopoly legislation prove completely sufficient,” the head of land department explained.

It is evident that in 2013 in connection with the change of order of registration of leasing contracts many agriculture producers will suffer certain difficulties. 

“That’s why we jointly with the Justice Ministry speak for a legislative initiative concerning simplification of a procedure of registration of land rights in the terms of lease. In particular, it is suggested to conduct registration of right of lease of land shares without recurrent primary registration of property rights of citizens for the given land plot. The principal aim we want to achieve by our legislative initiatives in relations with big and average agribusiness is to preserve the existing economically beneficial conditions of lease management in Ukraine, and to confirm it with the increase of social stability and also with the state guarantees of the acquired rights and their free flawless circulation,” Serhiy Tymchenko summed up.
