OREANDA-NEWS. April 03, 2013. The Ministry of Economics of the Republic of Belarus jointly with the “Pricing Centre” Republican Unitary Enterprise organized a workshop on “Antimonopoly Regulation and Development of Competition under the Framework of the Common Economic Space” in Minsk. Darya Ognevskaya, the Head of the Judicial Unit of the Legal Department of the Federal Antimonopoly Service (FAS Russia), made a presentation addressing the workshop.

Attendees included representatives of companies and officers of the antimonopoly bodies of the Republic of Belarus and the Russian Federation. The workshop was opened by the Director of Pricing Policy Department of the Ministry of Economics of the Republic of Belarus, Igor Fomin.

Darya Ognevskaya made a presentation on “Enforcement possibilities of No.135 “On Protection of Competition” to actions of foreign companies”, where she highlighted the issues related to exterritoriality of the norms of the law on competition protection and enforcement practice with regard to Belorussian companies operating in the Russian Federation.

Darya Ognevskaya also covered such issues as possibilities of control over economic concentration provided by the antimonopoly law and discussed the practices of the Supreme Arbitration Court of the Russian Federation and Cassation Courts on antimonopoly cases in 2010-2012.

Belorussian companies showed a considerable interest to the presentation. In the course of the follow-up discussion, Darya Ognevskaya answered questions from the workshop participants.

“It should be pointed out that most questions were related to FAS approaches to determining the limits of acceptable conduct of market participants as well as measures that can be undertaken for the purposes of preventing antimonopoly violations. A special interest was expressed to FAS practice for agreeing upon companies’ commercial-and-sales policies reflecting their requirements to counteragents, the procedures for selecting counteragents, as well as the conditions for granting discounts and premiums”, stated the Head of the Judicial Unit of the Legal Department, Darya Ognevskaya.
