OREANDA-NEWS. December 19, 2013. The Federal Arbitration Court of the North-Siberian District (Irkutsk) dismissed a cassation appeal of “TGK-14” OJSC on invalidating the judgment of Arbitration Court of the Republic of Buryatia and the ruling of the 4th Arbitration Appeal Court that pronounced legitimacy of the actions undertaken by the Office of the Federal Antimonopoly Service in the Republic of Buryatia (Buryatia OFAS Russia).

Buryatia OFAS Russia found that “TGK-14” OJSC violated the Federal Law “On Protection of Competition”. The company was imposing disadvantageous contract conditions and conditions irrelevant to the contract subject or not directly provided for in the law of the Russian Federation, upon consumers of heat and hot water supply services, in the part of the methods and forms of payment for the consumed utilities without a possibility to pay directly to “TGK-14” OJSC in cash without commission.

The antimonopoly body fined the company over 23 million RUB.

“TGK-14” OJSC disagreed with the decision of Buryatia OFAS Russia and filed a lawsuit, the Federal Arbitration Court of the North-Siberian District dismissed the claim.
