IRU Lodges Complaint Against Tirol Sectoral Traffic Ban for Trucks
OREANDA-NEWS. IRU has submitted a formal complaint with the European Commission over the proposed measure which will ban trucks over 7.5 tonnes carrying certain goods on a section of the A12 in the Inn valley in Tirol, Austria.
IRU contacted Commissioner Bulc (Transport), Commissioner Bie?kowska (Growth) and Commissioner Vella (Environment) calling for the European Commission to undertake the appropriate legal action to prevent the ban’s entry in to force on 1 November 2016.
Tirol has attempted twice in the past to introduce such a ban, with the European Court of Justice ruling in both cases that the measure would not comply with EU law. Tirol is going ahead with the current ban despite the critical outcome of the European Commission’s reasoned opinion, issued in March 2016, which states that the measure fails to comply with the principle of proportionality.
