OREANDA-NEWS. April 05, 2010. The Supreme Arbitration Court (SAC) transferred the case of "TNK-BP" to the SAC Presidium upon a supervisory appeal of the Federal Antimonopoly Service (FAS Russia). The company is challenging the decision and determination, as well as the fine imposed by the Antimonopoly Service, for monopolistic overpricing (petrol and aviation kerosene).

In summer 2008, FAS Russia found that "Rosneft", "Gazprom Neft", "LUKOIL" and "TNK-BP" had been fixing monopolistically high prices for petrol, diesel fuel, aviation kerosene and fuel oil.

The companies were fined from 1.1 billion to 1.5 billion Rubles: "Rosneft"- 1.5 billion Rubles, "Gazprom Neft"- 1.35 billion Rubles, "LUKOIL" - 1.44 billion Rubles and "TNK-BP" - 1.1 billion Rubles.

All companies challenged the FAS Russia's decisions and determinations on violating the antimonopoly law and fines imposed by FAS Russia.

In 2009, the Courts of three instances ruled invalid the FAS Russia decision on imposing administrative charges upon "TNK-BP" and other documents issued by the Antimonopoly Service - the decision, which found that "TNK-BP" had violated the Federal Law "On Protection of Competition", and the determination to stop abusing market dominance.
