OREANDA-NEWS. On April 26, 2007 the 9th Arbitration Appeal Court sustained the ruling of the first instance court that confirmed the rightness of the position of the Federal Antimonopoly Authority towards "Gaspromtrans" Ltd, reported the press-centre of FAS Russia.
On 29th January 2007, the Moscow Arbitration Court dismissed the claim of "Gaspromtrans" Ltd. on invalidating the order of the Federal Antimonopoly Authority (FAS Russia) to include the company into the Register of Economic Entities Holding Over 35% Share on a Certain Product Market ("On Amendments to the Register of Economic Entities Holding Over 35% Share on a Certain Product Market").
In summer 2006 FAS Russia analyzed the market of offering proprietary rolling stock for liquid sulfur transportation and found that the market share of "Gaspromtrans" Ltd. was over 65%. Therefore, FAS Russia included the company into the Register.
"Gaspromtrans" Ltd. disagreed with the decision of the antimonopoly authority and petitioned to the Moscow Arbitration Court on invalidating the order issued by FAS Russia.
The Court however, found that the argumentation presented by the company was unsubstantiated and, therefore, confirmed the rightness of the position taken by the antimonopoly authority on including "Gaspromtrans" Ltd. in the Register. The 9th Arbitration Appeal Court dismissed the company's complaint and sustained the judgment of the first instance court.
