OREANDA-NEWS. On May 17, 2007 the Federal Antimonopoly Service (FAS Russia) initiated a case against "RZhD" OJSC which refused to enter into agreements for special conditions of beer transportation in June, July and August 2007 in specially equipped cars. It would force the cargo owners to use for transportation the rolling stock of a "Refservice" OJSC, a daughter company of "RZhD" OJSC, reported the press-centre of  FAS Russia.
The case was initiated following a petition of the "Baltika" Pivovarennaya Companiya [Brewing Company"] OJSC and "Heineken Pivovarnya [Brewery] Ltd. on violating Article 10 of the Federal Law "On Protection of Competition": an economic entity with dominant position on the market of railway cargo transportation committed actions towards preventing, restricting or eliminating competition and infringing the interests of other economic entities.
In 2005, FAS Russia had already considered such a violation (abusing by a carrier - "RZhD" OJSC - the right to set special conditions for cargo transportation (pasteurized beer). "RZhD" OJSC had appealed against the decision passed by FAS Russia by the court of two instances had dismissed the appeal and sustained the FAS Russia's decision.
