OREANDA-NEWS. On November 07, 2007 the Federal Antimonopoly Service (FAS Russia) forwarded to the Federal Agency on Culture and Cinematography (the ordering party) and the "Bina Company" CJSC (the petitioner) its decision regarding the complaint of the "Bina Company" CJSC against the actions undertaken by the ordering party in the open bidding for supplying lighting and sound engineering equipment (lots №1 and №2), reported the press-centre of FAS Russia.

FAS Russia established that the bidders were given additional requirements, which contravened the Federal Law "On State and Municipal Procurement of Goods, Works and Services". In particular, the ordering party requested to present a certificate confirming bidder's registration in the Russian Federation, information confirming the quality of similar and equivalent supplies completed by a bidder, and information about the company's resources (material and technical resources, professional and technical personnel, and financial resources) as well as set additional requirements to the extract from the Unified State Register of Legal Persons and Sole Traders. The above requirements were in breach of Part 4 Article 25 and Part 2.1 Article 22 of the Federal Law' On State Procurement…".

Furthermore, the tender notification did not contain information about the location of bids opening, bids consideration and announcing the tender results as well as the goods delivery place and the quantity of supplied goods which contravened Part.4 Article 21 of the Federal Law' On State Procurement…".

Having considered the case, the antimonopoly authority also established that the ordering party had already concluded public contracts for supplying the equipment regarding both lots. Therefore, in its decision FAS Russia indicated possibility of canceling the tendering on both lots through legal enforcement procedures.
