OREANDA-NEWS. February 19, 2008. The Federal Antimonopoly Service (FAS Russia) forwarded to the Tender Commission of the Chief Tank-Automotive Command, the Russian Ministry of Defence (the Ordering Party) and "MAKS" CJSC (the Petitioner) its decision regarding the complain of the Petitioner against the actions undertaken by the Tender Commission in an open bidding for selecting insurers to carry out compulsory civil liability moor-vehicle insurance for the Russian Ministry of Defence, reported the press-centre of FAS Russia.

FAS Russia established that the ordering party violated the procedures for evaluating the bids, specified in the tender documentation, and determined the winner in breach of the state procurement legislation.

The Antimonopoly Service also established that the Tender Commission lawfully specified the criteria for bid evaluation in the tender documentation. Therefore, FAS Russia found the arguments of "MAKS" CJSC ungrounded.

As a result, the Antimonopoly Service recognized that the Tender Commission of the Chief Tank-Automotive Command, the Russian Ministry of Defence, violated Parts 2, 8 and 10 Article 28 of the Federal Law "On State and Municipal Procurement of Goods, Works and Services", and found the petition partly justified.

Furthermore, FAS Russia initiated administrative proceedings against officials of the ordering party under Part 2 Article 7.30. of the Code of Administrative Violations.
