OREANDA-NEWS. March 31, 2008. Due to unreliable information appeared in some mass media, the Federal Antimonopoly Service (FAS Russia) informs that requirements stated in the determination issued to "Rossiiskie Zheleznie Dorogi [Russian Railways]" OJSC ("RZhD" OJSC) and "Pervaya Grizovaya Compania [First Cargo Company]" OJSC ("PGK" OJSC) are in compliance with the current antimonopoly legislation, reported the press-centre of FAS Russia.

On 12th March 2008, FAS Russia held a meeting to discuss the decision passed by the Antimonopoly Service on issuing a determination to "RZhD" OJSC and "PGK" upon processing the notification on formation of a subsidiary of "RZhD" OJSC - the "First Cargo Company" OJSC.

The Head of FAS Russia Igor Artemyev, Senior Vice-President of "RZhD" OJSC, Mr Fyodor Andreev, the General Director of the "First Cargo Company" OJSC, Mr Slaman Babev, the Head of the DZO Department, of "RZhD" OJSC, Mr Gleb Fedulov and other representatives of the companies and the antimonopoly authority.

At the meeting the parties considered all presented argumentation and heard clarifications given by the antimonopoly authority, which confirm that the FAS Russia's requirements specified in the determination to "RZhD" OJSC and "PGK" OJSC are in compliance with с the Federal Law "On Protection of Competition".

The FAS Russia's determination specifies actions towards protection of competition and preventing discriminatory conditions for physical (legal) persons, who own cars as a property and (or) based on any other statutory rights and who are carrying out operator's economic activities on the basis of the contracts with a carrier, as well as to ensure the rights of a freight sender to use for transportation at his disposal the rolling stock of a carrier or any other owner (leaseholder) of the rolling stock, and observing the requirements to a carrier, specified in Article 12 of the Federal Law "On the Railway Transport in the Russian Federation".
