OREANDA-NEWS. April 02, 2008. The Federal Antimonopoly Service (FAS Russia) informed the Pension Fund of the Russian Federation (the Ordering Party) and "POCKET POWER" Ltd. (the Petitioner) about its decision on the complaint about violating the Federal Law "On State and Municipal Procurement of Goods, Works and Services" in an open bidding for the governmental contract on supplying paper for the office equipment to small businesses, reported the press-centre of FAS Russia.

In the Petitioner's opinion, the Auction Commission of the Ordering Party unreasonably rejected its participation in the auction because the Petitioner's bid did not specify the trademark of the paper to be supplied for the office equipment.

Having considered the case, FAS Russia established that the Ordering Party specified technical characteristics of the paper in the auction documentation. However, the requirement to indicate the trademark of a supplied paper was not specified. At the same time, according to the bid of "POCKET POWER" Ltd., the company offered to supply the paper with technical characteristics matching the requirements specified in the auction documentation. Therefore, rejecting the bid of "POCKET POWER" Ltd. violated Part 2 Article 12 the Federal Law "On State Procurement…".

FAS Russia disused a determination to the Pension Fund of the Russian Federation requesting it to withdraw the Auction Protocol and the Bids Prequalification Protocol, reconsider the bids and carry out the auction in accordance with he procedures established by the auction documentation and the Federal Law "On State Procurement…". In addition, the Antimonopoly Service initiated administrative proceedings against the Auction Commission of the Ordering Party under Part 2. Article 7.30 the Code of Administrative Violations.
