OREANDA-NEWS. On August 06, 2008 the Federal Antimonopoly Service (FAS Russia) initiated a case against "Closed Joint-Stock Company "CREDIT EVROPA BANK" and 13 insurance companies on the signs on the violation of the Article 11 of the Federal Law "On Protection of Competition" (prohibition of agreements restricting competition), reported the press-centre of FAS Russia.

The case was initiated after conducting inspection of the observance of the antimonopoly legislation by Closed Joint-Stock Company "CREDIT EVROPA BANK" in its interaction with the following insurance organizations:

"General'niy Strakhovoy Al'yans" LLC;

"Russkaya Strakhovaya Companiya" OJSC;

"GUTA-Strakhovanie" LLC;

"Insurance Company "Zurich. Retail" LLC (former title - "Insurance Company "NASTA" LLC);

"Rosgosstrakh-Tatarstan" LLC;

"Rosgosstrakh-Stolitsa" LLC;

"Rosgosstrakh-Povolzh'e" LLC;

"Rosgosstrakh-Accord" LLC;

"Insurance Company "ORANTA" LLC;

"Insurance Group "ASKO" LLC;

"Insurance Society "ASOL"CJSC;

"GSK "Yugoriya" OJSC.

The FAS Russia perceives the sighs on the violation of antimonopoly legislation in concluding written agreements between the bank and given insurance companies within the frameworks of different crediting programs that lead or may lead to the restriction of competition as well as to economically or technologically unjustified refusal from concluding contracts with certain individual persons, imposing on individual persons of contractual terms which are disadvantageous for the latter and are not connected with the subject of the agreement.

The case will be heard on August 25, 2008.

Pursuant to Article 11 of the Federal Law "On Protection of Competition" the agreements of economic entities are forbidden if such agreements lead or may lead to:

- economically or technologically unjustified refusal from concluding contracts with certain sellers or purchasers (customers) if such refusal is not provided for by the federal laws, statutory legal acts of the President of the Russian Federation, statutory legal acts of the Government of the Russian Federation, statutory legal acts of the authorized federal bodies of executive power or judicial acts;

- imposing on a counterparty of contractual terms which are disadvantageous for the latter and are not connected with the subject of the agreement.


Besides, the agreements between economic entities are forbidden if such agreements lead or may lead to restriction of competition.
