OREANDA-NEWS. September 08, 2008. The Federal Antimonopoly Service (FAS Russia) recognized that the Administration of Justices of Peace in the Moscow region violated the Federal Law "On State and Municipal Procurement of Goods, Works and Services" and issued a determination to eliminate the violations, reported the press-centre of FAS Russia. 

The case was initiated upon a petition of "Metmebel.ru" Ltd. The Petitioner stated that the Administration of Justices of Peace in the Moscow region violated the law in the open bidding for supplying filing cabinets, furniture and equipment for the needs of judicial districts.

In its complaint, the Petitioner specified that the Tender Commission of the Ordering Party unlawfully rejected the company's bid at the pre-qualification stage.

Investigating the case, FAS Russia established that the bid of "Metmebel.ru" Ltd. included some documents that were singed without clarification of the signatures, which was a requirement set by the tender documentation; effectively, it constitutes the grounds for refusal to accept the bid in accordance with Article 12 of the Federal Law.

At the same time, the tender documentation, published on the official site www.gz-mo.ru, did not match the tender documentation approved by the Ordering Party in terms of technical specification of the furniture items (the subject of the complaint), which breached Part 4 Article 23 of the Federal Law. Also, the tender documentation specified the "ALBA aries 513" trademark as the required sofa and armchair upholstery, which was in breach of Part 3 Article 22 of the Federal Law.

Furthermore, the tender documentation required the bidders to submit the price tables for supplies of furniture and equipment, which violated Part 4 Article 25 of the Federal Law and constitutes an administrative office under Part 4 Article 7.30 of the Code of the Russian Federation on Administrative Violations.

Having investigated the case, FAS Russia recognized the complaint of "Metmebel.ru" Ltd. partially justified and issued a determination to eliminate the violations.
