OREANDA-NEWS. On September 30, 2008, the Federal Antimonopoly Service (FAS Russia) accepted from X5 Retail Group N.V. the Common Rules for selecting the suppliers to buy the goods for reselling in St Petersburg, and for controlling execution of the contracts, their early termination and settlements, reported the press-centre of FAS Russia.

The Rules have been finalized in accordance with the FAS Russia's comments and criticism.

Earlier FAS Russia received a petition from X5 Retail Group N.V. on acquiring the rights that would enable the company to determine entrepreneurial activities of "Rusel" Ltd. Having processed the petition, FAS Russia concluded that the transaction might restrict competition.

The petition was granted, but FAS Russia issues a determination on preventing the actions that can result in restricting competition on the market of food retailing in St Petersburg and the goods markets, where the group of persons of X5 Retail Group N.V. buys the goods for reselling.

In particular, FAS Russia instructed X5 Retail Group N.V. to devise common rules according to which the company and the economic agents - members of its group - are to control execution of the contracts, their early termination and settlements, as well as the list of their services and their costs.

X5 Retail Group N.V. disagreed with the FAS Russia's determination and filed a law suit to the Arbitration Court attempting to invalidate it.

Currently the company has finalized the necessary documents and presented them to the antimonopoly body.
