OREANDA-NEWS. October 09, 2008. The Moscow Arbitration Court dismissed the claim of "Rus-Alco" Ltd. on invalidating the decision of the Federal Antimonopoly Service (FAS Russia), reported the press-centre of FAS Russia.

On 9th June 2008, FAS Russia recognized that "Rus-Alco" Ltd. violated Clause 4 Part 1 Article 14 of the Federal Law "On Protection of Competition" by commercializing "Medovukha" vodka, illegally combining trademarks under Nos. 334711, 334712, 334713, 334809, 335595, 335596 Certificates (class 33 of the International Classification of Goods and Services).

The company disagreed with the decision of the antimonopoly authority and filed a claim to the Moscow Arbitration Court on invalidating it, which was dismissed by the Court.

Clause 4 Part 1 Article 14 of the Federal Law "On Protection of Competition" prohibits unfair competition related to selling, exchanging or otherwise commercializing the goods with illegal use of intellectual property or equivalent means of differentiating a legal persons or means of differentiating the goods, works or services.
