OREANDA-NEWS. On October 16, 2008, the Federal Antimonopoly Service (FAS Russia) recognized that the group of persons of "EuroChem" Mineral and Chemical Company" OJSC and "Kovdorsky Mining-and-Processing Works" OJSC violated Clause 8 Part 1 Article 10 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.

The group of persons of "EuroChem" Mineral and Chemical Company" OJSC and "Kovdorsky Mining-and-Processing Works" OJSC violated the antimonopoly legislation by abusing dominant position on the goods market of apatite concentrate: the companies created discriminatory conditions for "GMZ" Trading House" Ltd. entering to the market of apatite concentrate.

"GMZ" Trading House" Ltd. produces mineral fertilizers using the facilities of "Hydro-Metal Works" OJSC, apatite concentrate is the main raw material for the fertilizers.

FAS Russia will issue the decision and determination on the case within the statutory period.

Under Article 14.31 of the Code of Administrative Violations of the Russian Federation, abusing dominant position is an administrative offense punishable by a fine: upon legal entities - 1-15% of the net sales of the violator on the market where the violation occurred in the year preceding the year when the violation was revealed but no more than 2% of the total net sales.
