OREANDA-NEWS. October 22, 2008. The Office of the Federal Antimonopoly Service (OFAS Russia) in the Adygeya Republic fined the "Maikop Heat Supply Network" Municipal Unitary Enterprise 3,141,430 Rubles for violating the antimonopoly legislation, reported the press-centre of FAS Russia.

Earlier the Adygeya OFAS Russia recognized that the "Maikop Heat Supply Network" Municipal Unitary Enterprise violated Part 1 Article 10 of the Federal Law "On Protection of Competition". The company breached the law by imposing unfavorable contract conditions upon the customers.

The antimonopoly case was initiated upon a petition of the "ZhSK-30" Housing Cooperative. The Housing Cooperative asked "Maikop Heat Supply Network" to issue technical specifications for installing additional heating pipes and for installing a heat metering device. In response, the "Maikop Heat Supply Network" Municipal Unitary Enterprise agreed to issue technical specifications only upon installing two metering units: for the heating system and for the hot water supply system, explaining that technical specifications must be issued as a package.

Having investigated the case, the Adygeya OFAS Russia concluded that such requirements were not relevant to the subject matter of the contract and were not justified.

Under Article 14.31 of the Code of Administrative Violations of the Russian Federation, antimonopoly violations committed by legal entities are punishable by a fine - 1-15% of the company's net sales on the market where the violation occurred.
