OREANDA-NEWS. On November 19, 2008 the Federal Antimonopoly Service (FAS Russia) recognized that "Alcoa Rus" Ltd. violated Clause 1 Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing dominant market position), reported the press-centre of FAS Russia.

The case was initiated upon a petition of "Oboroncomplex" Public Corporation" OJSC ("Oboroncomplex" GAK" OJSC) about the increase of ex-works prices for some aluminum profiles supplied in 2007-2008 by "Alcoa Rus" Ltd. on requests of "Oboroncomplex" GAK" OJSC for the needs of aviation industry company.

The group of persons including"Alcoa Rus" Ltd. and "Samara Metal Works" violated the antimonopoly legislation by fixing monopolistically high prices.

Under Article 14.31 of the Code of the Russian Federation on Administrative Violations, abusing dominant position is punishable by administrative fines upon legal entities from 1 to 15% of the net sales of the violator on the market, where the violation occurred, in the year preceding the year, when the violation was revealed, but no more than 2% of the net sales of all goods.

Determining the fine, FAS Russia took into account the measures undertaken by "Alcoa Rus" Ltd. to eliminate the antimonopoly violations and its consequences.

The decision and determination on the case will be prepared within the statutory period.
