OREANDA-NEWS. December 04, 2008. Representative office of the State Committee on Regulatory Policy and Entrepreneurship in Kyiv hasn’t agreed a draft ordinance of Kyiv municipal state administration of November 28 of the current year which suggests raising of tariffs for heat and power energy, centralized heating and cold/hot water supply.

The committee refuses to approve the regulatory act for the second time as it significantly increases the tariffs for certain categories of enterprises. The head of Kyiv municipal state administration gave three orders on October 30, 2008 with which the tariffs for some enterprises and budget institutions had been raised 10fold. On November 20 President of Ukraine Viktor Yushchenko cancelled the order of Kyiv municipal head Leonid Chernovetsky of October 30.

The recent draft of November 24 is viewed by the municipal authority as such which takes into account demands of the President of Ukraine and the Antimonopoly Committee. Though the difference of the second draft consists in the fact, the level of raising of tariffs for “other consumers and certain economy subjects” have been cut by 5%.

At the same time, though short, a list of enterprises which are obliged to pay on significantly higher tariffs still remains. The State Committee on Regulatory Policy and Entrepreneurship notes such shocking raising of tariffs in fact becomes an additional tax for certain kinds of entrepreneurship while setting taxes is not within competence of Kyiv municipal authority.

The proposed in the draft order of payments contradicts to the Order of payment of tariffs for the mentioned communal services approved by the Cabinet of Ministers of Ukraine №560 of July 12, 2005, which defines a mechanism of forming tariffs for services from maintenance of houses and constructions and adjoining territories and applies to economy subjects of all property forms providing with the mentioned services. Suggested by Kyiv municipal authority 10fold increase of communal services doesn’t comply with their prime cost. The draft order also violates an order on correcting the tariffs determined by the Ordinance of the Cabinet of Ministers of Ukraine of July 12, 2006 №959.

The head of State Committee on Regulatory Policy and Entrepreneurship Kostyantyn Vashchenko stressed any changes in the tariff policy in communal sphere have to be made exceptionally within the limits of legal field and taking into account interests of all the parties – local society, entrepreneurs and the authorities.
