OREANDA-NEWS. December 08, 2008 The Federal Antimonopoly Service (FAS Russia) imposed an administrative fine 300 000 Rubles upon "Sem' Dnei [7 Days]" Publishing House" CJSC for failure to execute the determination to stop the violations of the Federal Law "On Advertising", reported the press-centre of FAS Russia.

On 9th June 2008, FAS Russia pronounced that the advertisement of the medical services offered by "Penta-Clinic" Diagnostic and Treatment Centre" Ltd. was unfair. The advertisement was published by "Sem' Dnei" Publishing House" CJSC in No.10 " Sem' Dnei TV-programma [7 Days TV-programme]" magazine for 3-9 March 2008 on page 109. In violation of Article 16 of the Federal Law "On Advertising", the advertisement did not have the notes "advertisement" or "for advertising purposes".

Upon finding of the facts of the violation, FAS Russia issued a determination to the Publishing House that within 30 days it should stop publishing the advertisement without the statutory note "advertisement" or "for advertising purposes".

As the Publishing House had failed to execute the determination, under Clause 2.4 Article 19.5 of the Code of the Russian Federation on Administrative Violations, FAS Russia imposed administrative charges upon the Publishing House and fined it 300 000 Rubles.

Article 16 of the Federal Law "On Advertising": placing of the body of the text of an advertisement in periodic print media, that do not specialize on announcements and materials of advertising nature, must be accompanies by the note "advertisement" or "for advertising purposes".

According to Clause 2.4 Article 19.5 of the Code of the Russian Federation on Administrative Violations, for failure to execute within the statutory period a determination to stop violations of the advertising legislation FAS Russia can imposed a fine upon legal entities from 300 000 to 500 000 Rubles.
