OREANDA-NEWS. December 10, 2008. The 9th Arbitration Appeal Court confirmed validity of the decision of the Federal Antimonopoly Service (FAS Russia) that "Victoria" was engaged in unfair competition, reported the press-centre of FAS Russia.

On 29th February 2008, FAS Russia recognized that "Victoria" Ltd. violated Part 2 Article 14 of the Federal Law "On Protection of Competition" by acquiring and using exclusive rights of "Agroselprom" Ltd. for the combined trade mark with the "Golden Kings" verbal element, under No. 326164 Certificate.

"Victoria" Ltd. appealed the decision of the antimonopoly authority to the court of law.

The Moscow Arbitration Court dismissed the appeal of "Victoria" Ltd.

On 3rd December 2008, the 9th Arbitration Appeal Court, Moscow, sustained the ruling of the Moscow Arbitration Court, and confirmed validity of the FAS Russia's decision.

Part 2 Article 14 of the Federal Law "On Protection of Competition" prohibits unfair competition, related to acquiring and using exclusive rights for the means of differentiation a legal entity, or the means of differentiating goods, work or services.
