OREANDA-NEWS. December 23, 2008. The Federal Administrative Service (FAS Russia) warned Oleg Voitsekhovsky, the Managing Director of the Russian Council of Trade Centres, on inadmissibility of public recommendations to the market participants regarding the lease conditions on the market of commercial and leisure real estate, reported the press-centre of FAS Russia.

According to FAS Russia, such recommendations to the members of the association can coordinate economic activities of the market entities, which contravenes Part 3 Article 11 of the Federal Law "On Protection of Competition".

The reason for the FAS Russia's warning was the address of the market participants published on the website of the "Russian Council of Trade Centres" Non-Commercial Partnership. The text of the address has several statements that can be interpreted as a request to refuse to reconsider the lease conditions and price policy on the market of commercial and leisure real estate, in particular, as refusal to reduce prices in leasing the premises.

"The Russian Council of Trade Centres is a specialized industry association, and expressing a certain position on its behalf regarding this issue can be perceived by the market participants as a price policy indication", - is convinced Irog Artemyev, the Head of the Federal Administrative Service (FAS Russia).- Recommendations by the Director of the Russian Council of Trade Centres can mean coordination of the price policy among the members of the association. In no way is FAS Russia infringing the freedom of speech but the Antimonopoly Service reminds that from the standpoint of the antimonopoly legislation such statements and forecasts on behalf of the specialized industry association can be classified as coordination of economic activity".
