OREANDA-NEWS. December 29, 2008. The Federal Antimonopoly Service (FAS Russia) found that the Ministry of the Russian Federation on Civil Defense, Emergencies and Disaster Relief (MChS Russia) breached Article 15 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.

MChS Russia violated the law by assigning the functions of a federal executive body to "Delovoi Express" Financial Publishing House" CJSC ("FID "Delovoi Express" CJSC), the co-founder and publisher of the "Problemy Analiza Riska" magazine. FAS Russia closed the proceedings due to voluntary elimination of the violation.

Investigating the case, FAS Russia established that on 9th January 2008 MChS Russia issued an order, approving the Regulations on informing the population on the safety of hazardous facilities and living conditions in the vicinity of such facilities. According to the Regulations, "FID "Delovoi Express" CJSC was in charge of collecting and analyzing the data on the safety of hazardous facilities for their subsequent publication in the "Problemy Analiza Riska" magazine.

The price set by "FID "Delovoi Express" CJSC charged the heads of hazardous facilities 3200 for publishing information regarding one such facility (or 3750 Rubles including delivery of a copy of the magazine to the head of a hazardous facility); for publishing information about two and more hazardous facilities that belong to the same organization, the price of publishing data on every hazardous facility after the first one was 800 Rubles.

On 10th December 2008, MChS Russia issued an order invalidating the anticompetitive order of 9th January 2008. It formed the grounds for closing the case on violating the antimonopoly legislation.

FAS Russia recommended that in the future MChS Russia should not issue the acts assigning the rights and functions of a federal executive body to economic entities.
