OREANDA-NEWS. On December 26, 2008 the Federal Antimonopoly Service (FAS Russia) imposed administrative charges upon "АLCOA RUS" Ltd. and fined the company 1 772 102.55 Rubles for abusing dominant position on the market of aliminum shapes used in aircraft construction, reported the press-centre of FAS Russia.

Earlier FAS Russia found that "АLCOA RUS" Ltd. violated Clauses 1 and 6 Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position).

The case was initiated upon petitions of the "Oboronpromcomplex" State Shareholding Company (GAK "Oboronpromcomplex") regarding the growth of ex-works prices for some aliuminum profiles in 2008, supplied by "АLCOA RUS" Ltd. for the Russian aviation industry.

"АLCOA RUS" Ltd. violated the antimonopoly legislation by abusing dominant position on the market of aliminum profiles used for aircraft construction in the Russian Federation: fixing monopolistically high prices for aluminun profiles used for aircraft construction, in April 2008 and setting different prices for the profiles without economic or technological justification.

Pursuant to the Article 14.31 of the Code on Administrative Violations of the |Russian Federation abusing dominant position results in imposing an administrative penalty upon legal persons amounted to one hundredth to one fifteenth part of the violator' proceeds of the sales of goods in the market where the violation occurred, but not more than one fiftieth part of the gross amount of violator' proceeds of the sales of all goods.

Determining the fine, FAS Russia took into account assistance offered by "АLCOA RUS" Ltd. to the investigators and the measures undertaken by the company to eliminate the antimonopoly violations and their consequences.
