OREANDA-NEWS. January 23, 2009. AB Mazeikiu Nafta recovered the 32 million litas fine imposed by the Competition Council in 2005 for the alleged violations of the competition regulations, reported the press-centre of Mazeikiu Nafta.

AB Mazeikiu Nafta’s position has always been that the fine was imposed unreasonably. The Company appealed the Vilnius Regional Administrative Court against the Competition Council’s decision. In 2007, the court ruled that AB Mazeikiu Nafta had not violated the competition regulations and the fine was imposed unreasonably.

In December 2008, the Supreme Administrative Court of Lithuania in its ruling also stated that the accusations against Mazeikiu Nafta that it abused its dominant position, by selling petroleum products to Lithuania at prices higher than to the other Baltic countries, are unreasonable. The court ruled to the Competition Council to return the fine paid by Mazeikiu Nafta in the early 2006.

AB Mazeikiu Nafta will claim for recovery of the costs associated with the legal proceedings and for payment of the interest on the amount of unreasonably levied fine paid by the Company.
