OREANDA-NEWS. On January 26, 2009 "ALCOA RUS" Ltd. informed the Federal Antimonopoly Service (FAS Russia) on transferring to the federal budget 1 772 102 Rubles - the fine imposed upon the company for abusing dominant position on the market of aluminum profiles, used in aircraft manufacturing, reported the press-centre of FAS Russia.

FAS Russia found that "ALCOA RUS" Ltd. violated Clauses 1 and 6 Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position).

The antimonopoly case was initiated upon petitions of the "Oboronpromcomplex" State Shareholding Company (GAK "Oboronpromcomplex) about the growth of the ex-works prices for some types of aluminum profiles supplied by "ALCOA RUS" Ltd. in 2008 for the needs of the Russian companies in the aircraft industry.

"ALCOA RUS" Ltd. violated the antimonopoly legislation by abusing dominant position on the market of aluminum profiles, used in aircraft manufacturing in the Russian Federation. In April 2008 the company fixed monopolistically high prices for aluminum profiles used in aircraft manufacturing, and also fixed different prices for the product without any economic or technological justification.

Under Article 14.31 of the Code of the Russian Federation on Administrative Violations, abusing dominant position is punishable by an administrative fine upon legal entities in the amount of 1 - 15 % of the total net sales of the violator on the market where the violation was committed, in the year, preceding the year, when the violation was discovered, but no more than 2 % of the net sales of all goods.

Determining the fine, FAS Russia took into account the assistance of "ALCOA RUS" Ltd. to the antimonopoly investigation and the measures undertaken by the company to eliminate the antimonopoly violations and their consequences.
