OREANDA-NEWS. On February 02, 2009 the President of the Republic of Belarus signed Decree No 58 ‘On Some Measures to Protect Proprietary Rights as Land Plots Are Withdrawn for State Needs'. The President also approved the Provisions on the procedure of selling citizen’s and organizations’ proprietary rights in cases of withdrawal of their land plots, reported the Official website http://president.gov.by.

The purpose of Decree No 58 is to improve legal regulation in securing the rights of landowners and other persons in cases of withdrawal of their land plots for state needs and demolition of the intangible property located there.

The Decree and the Provisions set a clear and detailed procedure for selling proprietary rights of citizens and organizations in cases of withdrawal of their land parcels. These documents also set the procedure and the sequence in which the related decisions should be made by government bodies, and the terms of assessing the buildings to be demolished.

Prior to this Decree, the issues related to the withdrawal of land plots for state needs and resettlement of the citizens living in the residential houses planned for demolition used to be regulated by a number of enforceable legal acts which legal effect varied. This failed to ensure the appropriate security of citizens’ housing rights and used to cause numerous well-grounded complaints on their part.

The new Decree explains clearly the issues relating to the selling of the proprietary rights of citizens living in single-family homes, multi-storied apartment blocks and those of legal entities in cases of demolition of the living spaces that belong to them.
