OREANDA-NEWS  On 20 February was announced, that the Federal Antimonopoly Service (FAS Russia) initiated a case against the Kemerovo regional Authority for violating Part 1 Article 15 of the Federal Law "On Protection of Competition".

The governor of the Kemerovo region signed No.143-OZ regional Law "On Prohibition of Activities for Receipt of Scrap and Nonferrous Waste" of 29th December 2008, which prohibits activities for receipt of scrap and nonferrous waste in the Kemerovo region. State authorities of the Kemerovo region violated the antimonopoly legislation by adopting an act, which leads or can lead to preventing, restricting or eliminating competition and forbids or restricts particular activities.

Under Article 13.1 of the Federal Law "On Industrial Waste and Consumption", physical persons can dispose of scrap and nonferrous waste generated by the household use of nonferrous products, owned by these persons, in a manner prescribed by the legislation of the Russian Federation; legal entities and individual entrepreneurs can handle and dispose of scrap and nonferrous waste provided they have documentary evidence of their ownership of such scrap and nonferrous waste.
