OREANDA-NEWS  On 26 February was announced, that the Federal Antimonopoly Service (FAS Russia) found that the Federal Agency for Geodesy and Cartography violated the Federal Law "On State and Municipal Procurement of Goods, Works and Services" and issued a determination to eliminate the violation.

The case was initiated upon a petition of "Tsentr Kh.G.S.". The Petitioner stated that the Federal Agency had violated the law in an open tender for packaged supply of printing equipment for a map reproduction plan under construction.

The Petitioner complained that objects of the competitive tender was printing equipment that is included in the list of goods (works, services), approved by a Decree of the Government of the Russian Federation, the contracts for supplies (completion, offering) of which must be placed through auctions. Contracts for the supplies of printing equipment for state or municipal needs cannot be places through tenders.

FAS Russia found the complaint justified.

According to the Government Decree "On the list of goods (works, services), the contracts for supplies (completion, offering) of which must be placed through auctions", the contract for supplying the goods, specified in the tender documentation and the "Project Statement" of the tender documentation, must be placed through an auction.

The decision of the Ordering Party on placing the contract through an open tender violated Part 4 Article 10 of the Federal Law "On State and Municipal Procurement of Goods, Works and Services" and constitutes an administrative violation under Part 2 Article 7.29 of the Code of the Russian Federation on Administrative Violations.

Having investigated the case, FAS Russia issued a determination to the Federal Agency for Geodesy and Cartography to nullify the tender.
