OREANDA-NEWS  On 26 February was announced, that governed by Clause 5 Part 2 Article 33 of the Federal Law "On Protection of Competition", the Federal Antimonopoly Service (FAS Russia) dismissed the petition of the "CATALPA INVESTMENTS LIMITED" private limited liability company on acquiring the rights, which will enable the company to determine the terms of business activity of economic entities operating in the Russia Federation (further on referred to as the Entities), by purchasing 49% shares of a private liability company - "MO-TV HOLDINGS LIMITED".

Information and documents submitted with the petition did not contain all information required by the antimonopoly authority to make a decision under Article 33 of the Federal Law "On Protection of Competition.

To obtain additional documents and information required to process the petition, FAS Russia requested such information on 19th December 2008.

"CATALPA INVESTMENTS LIMITED" did submit all additional information and documentation required for processing the petition.

Also the documents submitted to FAS Russia contained incorrect information.

Nevertheless, even on the basis of presented documents (contracts) FAS Russia has concluded that upon the transaction "CATALPA INVESTMENTS LIMITED" will be able to determine the terms of business activity of the Entities, while the petition specified the subject of transaction, which required approval of the antimonopoly body, as purchasing 49% shares of "МО-TV HOLDINGS LIMITED".

Under Clause 5 Part 2 Article 33 of the Federal Law "On Protection of Competition", the antimonopoly authority shall dismiss a petition if the information, presented in the petition and important for decision-making, is incorrect.
