OREANDA-NEWS. March 11, 2009. The Federal Antimonopoly Service (FAS Russia) found that the advertisement of the products of "AO Schering" CJSC and the advertisement of the services provided by "MEDHELP" Ltd. were unfair, reported the press-centre of FAS Russia. 

FAS Russia found that the advertisement of "AO Schering" CJSC - "A pack with zest" violated Part 8 Article 24 of the Federal Law "On Advertising", because it contained images identical to the "Levitra" prescribed drug. The advertisement was displayed on the advertising structures and was published in the print media.

The Antimonopoly Service issued determinations to the advertiser - "AO Schering" CJSC - and the advertising distributors - "Proximity" CJSC, "OMD Media Direction" CJSC, "Za Rulyom" Publishing House" Ltd., "United Press" Ltd. and "Burda" Publishing House" CJSC - to stop unfair advertising.

FAS Russia also found that the advertisement of medical services of "MEDHELP" Ltd., published in the "Krasota&Zdorovye" magazine by "Delovoi Mir" Publishing House" Ltd., was unfair. The space of the mandatory warning in the advertisement was less than required by Part 7 Article 24 of the Federal Law "On Advertising".

The Antimonopoly Service issued determinations to the advertiser - "MEDHELP" Ltd. and the advertising distributors - "INTELLEKT-RITs" Advertising and Information Centre" Ltd. and "Fortuna Media" Ltd. - to stop distributing the advertisement.

Under Part 8 Article 24 of the Federal Law "On Advertising", advertisements of medicines must not guarantee a positive effect of the object of advertising,, its safety, efficiency and absence of side effects.
 
Part 7 Article 24 of the Federal Law "On Advertising", advertisements of medical services must have a warning on possible counterindications. In such advertisements, the warning must cover no less than fiver per cent of the advertising space (area).
