OREANDA-NEWS. April 13, 2009. Following the request of the Ministry of Justice of Latvia Sorainen has performed a research on legal regulation of real estate after completion of the land reform, reported the press-centre of Sorainen.

Laws that were adopted in the process of the land reform after Latvia regained its independence and that permitted existence of divided real estates (where a building owned by one person has been located on a land owned by another) were analyzed in the research.

These divided properties were mostly created during the denationalization and privatization process in 1990s, when the land and buildings located thereon were acquired by different persons or when the owner of the land leased out the land to another person for construction of buildings.
 
The urgency of the topic is determined by the necessity to complete the land reform and to deal with the problems that have emerged regarding the aforementioned divided real estates, as well as the claims lodged in the constitutional court questioning legitimacy of the so called "forced lease" relations.
 
Within the scope of the research Sorainen's lawyers identified the problems related to complete implementation of the concept of indivisibility of land and buildings stated in the Civil law and suggested possible solutions for these problems taking into account the foreign experience.
 
Girts Ruda, Lelde Lavina and Janis Likops have been involved in the research.
