OREANDA-NEWS. April 23, 2009. The Federal Antimonopoly Service (FAS Russia) filed a claim to the Moscow Arbitration Court on invalidating an order of the Federal Service for Control over Communications and Mass Communication (Rossvyaz'okhrankultura), reported the press-centre of FAS Russia.

Following the order, licenses for the services of mobile radio-telecommunication were granted upon the outcome of the tenders which were organized in 2007 on the basis of the tender documentation that contravened the antimonopoly legislation.

On 15th August 2007 FAS Russia pronounced that Rossvyaz', which formulated and approved the tender documentation, violated Article 17 of the Federal Law "On Protection of Competition". Based on its decision, and in accord with Part 4 Article 17 of the Federal Law "On Protection of Competition", FAS Russia filed a lawsuit on invalidating the tenders. The Moscow Arbitration Court passed judicial acts invalidating the tenders. The Appeal Instance confirmed legitimacy and relevance of those decisions.

According to FAS Russia, licenses granted upon invalid tenders must be revoked by a court of law, and new tenders must be based on competitive bidding.
