OREANDA-NEWS. April 30, 2009. The Federal Antimonopoly Service (FAS Russia) found that "Voskresenskie Mineralnie Udobrenia" OJSC violated Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position), reported the press-centre of FAS Russia.

The case was initiated upon a petition of "Voskresensky NIUiF" OJSC.

FAS Russia analyzed the market of sulfate-free phosphoric acid and established that "Voskresenskie Mineralnie Udobrenia" OJSC has dominant position on the relevant goods market.

Initially "Voskresenskie Mineralnie Udobrenia" OJSC and "Voskresensky NIUiF" OJSC were formed as a single research-and-production complex. At a later stage the companies belonged to different owners.

Until August 2008 "Voskresenskie Mineralnie Udobrenia" OJSC supplied sulfate-free phosphoric acid to "Voskresensky NIUiF" OJSC, which produced several purified phosphoric acids.

Starting form August 2008, "Voskresenskie Mineralnie Udobrenia" OJSC unilaterally stopped supplying sulfate-free phosphoric acid to "Voskresensky NIUiF" OJSC.

At the case hearing by the FAS Russia's Commission, representatives of "Voskresenskie Mineralnie Udobrenia" OJSC were questioned on economic and \ or technological reasons for terminating the supplies.

Explanations provided by "Voskresenskie Mineralnie Udobrenia" OJSC did not justify terminating the supplies.

The FAS Russia's Commission pronounced that "Voskresenskie Mineralnie Udobrenia" OJSC violated the antimonopoly legislation, in particular, by economically and technologically unjustified refusal to supply sulfate-free phosphoric acid to "Voskresensky NIUiF" OJSC in 2008.

Products based on sulfate-free phosphoric acid are also required by the car-manufacturing and food industries.
