OREANDA-NEWS. May 25, 2009. The Federal Antimonopoly Service (FAS Russia) pronounced that the advertisement of "Gingo Biloba" dietary supplement (the advertiser - "Evalar" Trading House"). The advertisement contravened Clause 1 Part 1 Article 25 of the Federal Law "On Advertising" by including information that created impression that "Gingo Biloba" has medicinal properties for treatment of vascular system diseases, reported the press-centre of FAS Russia.

The advertisement of the dietary supplement was broadcasted by "Radio Rossii [Radio Russia] radio station in May-June 2008.

FAS Russia issued a determination to the advertisers to stop broadcasting the unfair advertisement.

FAS Russia also initiated an administrative case against the advertiser - "Evalar" Trading House" Ltd. - to determine the liability (the size of a fine) for violating the advertising legislation.

Under Clause 1 Part 1 Article 25 of the Federal Law "On Advertising", advertisements of dietary supplements must not create an impression that the advertised dietary supplements are medicines or possess medicinal propertities.

On 12th May 2009, FAS Russia also pronounced that the advertisement of "Endocrinol" cr?me-gel, broadcasted in March-June 2008 by "Radio Russia", was unfair. In breach of Clause 6 Part 5 Article 5 of the Federal Law "On Advertising", the advertisement gave information creating an impression that "Endocrinol" cr?me-gel had medicinal properties and could have positive effects on thyroid diseases.

FAS Russia issued a determination to the advertisers to stop further disseminating the unfair advertisement and initiated administrative proceedings against the advertiser - "Evalar" Trading House" Ltd. - to determine the liability (the size of a fine) for violating the advertising legislation.

Clause 6 Part 5 Article 5 of the Federal Law "On Advertising" prohibits indication of medicinal properties (effects on the course of a disease) in the advertisements, except advertisements of medications and medical services, including methods of treatment, products for medical purposes and medical equipment.
