OREANDA-NEWS. May 26, 2009. The Office of the Federal Antimonopoly Service in the Belgorod region (OFAS Russia) fined "Belgorodskata Sbytovaya Kompania" OJSC 156,876,590 under Article 14.31 of the Code of the Russian Federation on Administrative Violations for breaching the antimonopoly legislation, reported the press-centre of FAS Russia.

The administrative case was initiated following the OFAS' decision on the fact of the violation. The company abused its dominant position on the goods market of selling electric power in the Belgorod region. The antimonopoly body found that "Belgorodskata Sbytovaya Kompania" OJSC violated Clause 5 Part 1 Article 10 of the Federal law "On Protection of Competition" (economically unjustified refusing or avoiding singing contracts with certain buyers (customers).

The case was initiated upon a petition of "Korporativnie Servisnie Sistemy" OJSC. The Petitioner stated that "Belgorodskata Sbytovaya Kompania" OJSC unreasonably refused to sing the contracts for buying and selling electric power.

Under Article 14.31 of the Code of the Russian Federation on Administrative Violations (abusing dominant position on the goods market), an administrative offence is punishable by an administrative fine in the amount from 1 - 15% of the proceeds gained by the violator by selling goods (works, services) on the market where the violations was committed.
