OREANDA-NEWS.  On 04 June was announced, that the Federal Antimonopoly Service (FAS Russia) found that advertisements of food products under "Rastishka" trademark were improper and violated Part 7 Article 5 of the Federal Law "On Advertising".

"Vimm-Bill-Dann Foods" Ltd. complained to FAS Russia about the advertising campaign of "Danone Industry" Ltd.

From January to December 2008 the following TV channels - "NTV", "TNT", "7TV", "TV#", "TV Daryal", "STS", "TV St Petersburg 5 Canal", "REN TV", "TV TSENTR", Rossia", "Pervy Canal", "Domashny" and "Zvezda" - demonstrated commercials of foods products: "Rastishka- grow well!".

The petitioner stated that the content and the form of presenting the Danone advertisements were aimed to persuade consumers that those products are baby food, do not contain preservatives and have special (useful) properties stimulating child's growth and overall development.

The information about protein and carbohydrates, put on the packing of the advertised goods, does not meet the requirements specified in Clause 3.1.1.5 of the "Hygienic Safety and Nutrition Value Requirements for Food Products. SanPiN 2.3.2.1078-01" for baby foods.

The packing also lacks information on the purpose and conditions of use of baby foods, required under Part 3 Article 18 of the Federal Law"On Quality and Safety of Food Products".

Having investigated the case, FAS Russia concluded that absence of essential information in the advertisements of food products under "Rastishka" trademark misled consumers with regard to the purpose and consumer qualities of the product.
