OREANDA-NEWS. July 20, 2009. The Federal Antimonopoly Service (FAS Russia) introduced to the Government a draft Decree of the Government of the Russian Federation "On Approving the Rules for Agreeing Transactions Completed by Foreign Investors or a Group of Persons, Which Includes a Foreing Investor, if They Participate in Authorised Capital of the Business Entities of Strategic Importance for Russian National Defence and State Security, and (or) Complete Transactions that Lead to Establishing Control over Such Business Entities", reported the press-centre of FAS Russia.

The draft Decree was devised in accordance with Part 6Article 11 of the Federal Law "Procedures for Foreign Investments in the Business Entities of Strategic Importance for Russian National Defence and State Security" and in order to execute the instructions of the Government Commission for Control over Foreign Investments in the Russian Federation.

The Rules, to be approved by the draft Decree, clarify requirements to the petitions on agreeing upon transactions completed by foreign investors or a group of persons, which includes a foreing investor, if they participate in the authorise capital of economic entities of strategic importance for the Russian national defence and state security, and (or) if they complete transactions that led to establishing control over such economic entities, in the part which is not regulated by the Federal Law, and must be established by the Government of the Russian Federation.

Introducing the draft Decree to the Government of the Russian Federation is the final state in executing the "Action Plan for Implementing the Federal Law "Procedures for Foreign investments in the Business Entities of Strategic Importance for Russian National Defence and State Security" and the Federal Law "On Introducing Amendments to Some Legislative Acts of the Russian Federation and Some Provisions of Legislative Acts of the Russian Federation due to Adopting the Federal Law "Procedures for Foreign investments in the Business Entities of Strategic Importance for Russian National Defence and State Security".
