OREANDA-NEWS. September 16, 2009. The Federal Antimonopoly Service (FAS Russia) issued a determination to the group of persons of "Russky Solod" OJSC to transfer to the federal budget 90,106,843 Rubles 4 kopecks for abusing dominant position, reported the press-centre of FAS Russia.

On 24th August 2009 the Federal Antimonopoly Service (FAS Russia) found that the group of persons of "Russky Solod" OJSC violated Clause 1 Part 1Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position).

The case was initiated upon a petition of "Baltika "Brewing Company" OJSC.

The group pf persons including "Russky Solod" Trading House" Ltd., "Voronovo Malting Plant [Voronovsky Zavod Po Proizvodstvy Soloda]" CJSC, "Ostrog Malting Plant [Ostrogozhsky Zavod Po Proizvodstvy Soloda]" Ltd. and "Orel Malting Plant [Orlovsky Zavod Po Proizvodstvy Soloda]" Ltd. violated the antimonopoly legislation by fixing monopolistically high prices for light barley brewer's malt (used for brewing) in 2008. It resulted / could have resulted in increasing beer production costs.

Under Article 51 of the Federal Law "On Protection of Competition", a person whose actions are recognized as monopolistic activities in accordance with the statutory procedures and are forbidden by the antimonopoly legislation, must, upon a determination of an antimonopoly body, transfer the income, obtained through such actions, to the federal budget.
