OREANDA-NEWS. October 06, 2009. The Federal Antimonopoly Service (FAS Russia) found that "UGMK-Holding" Ltd. abused dominant position on the zinc market (breaching Clauses 6 and 8 Part 1 Article 10 of the Federal Law "On Protection of Competition"), reported the press-centre of FAS Russia.

"UGMK-Holding" Ltd. violated the antimonopoly legislation by fixing economically, technologically and other wise unjustified mark-ups (premiums) in contracts for supplying zinc to consumers, and by creating discriminatory conditions for some consumers.

According to Alexei Ylyanov, the Head of the Department for Industry Control, the FAS Russia's determination will be aimed at creating equal conditions for all zinc consumers, both large and small companies.

This type of violations is punishable by an administrative fine under Article 14.31 of the Code on Administrative Violations. The fine can be from 1 to 15% of the total proceeds gained by the violator from selling goods in the market where the violation was committed in the year preceding the year when the violations was discovered.

In the first six months 2009, FAS Russia and its regional bodies initiated 4168 cases on violating the Federal Law "On Protection of Competition", of which 4603 for abusing dominant position.
