OREANDA-NEWS. November 25, 2009. The Office of the Federal Antimonopoly Service (FAS Russia) in the Belgorod region (the Belgorod OFAS Russia) fined "Russian Railways" OJSC ("RZhD" OJSC) 2,541,111,477 Rubles for violating the antimonopoly legislation, reported the press-centre of FAS Russia.

Earlier the Belgorod OFAS Russia found that "Russian Railways" OJSC violted Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position).

Investigating the case, OFAS Russia established that as a state-funded institution, "No.7 Correctional Colony" (in the town of Valuiki) could include into contracts for cargo transportation settlements a condition for an advance payment that would not exceed 30% of the contract sum. The refusal of "Russian Railways" OJSC to sing the contracts under the conditions that met the interests of the state-funded institution was classified by OFAS Russia as abusing dominant position.

Upon the fact of "Russian Railways" OJSC exercising the actions that were recognized as abusing dominant position and forbidden by the antimonopoly legislation of the Russian Federation, OFAS Russia initiated an administrative case under Article 14.31 the Code of the Russian Federation on Administrative Violations.

Upon considering the antimonopoly case, the Head of the Belgorod OFAS Russia issued a determination on imposing a 2,541,111,477 Rubles "turnover" fine.
