OREANDA-NEWS. December 09, 2009. The Arbitration Court of the Tyumen region allowed the claim of "ТNК-ВР Holding" OJSC on invalidating the decision and determination of the Federal Antimonopoly Service (FAS Russia) as well as the ruling on imposing an administrative fine upon the oil company for abusing dominance on the wholesale oil products markets, reported the press-centre of FAS Russia.

FAS Russia believes that its position is well-founded, and antimonopoly violations committed by the oil companies are proven. In the near future FAS Russia will lodge an appeal against the judgment of the Arbitration Court of the Tyumen region.

On 25th June 2009, FAS Russia found "ТNК-ВР Holding" OJSC violated Part 1 Article 10 of the Federal Law "On Protection of Competition". According to FAS Russia, "ТNК-ВР Holding" OJSC abused its dominance on the wholesale oil products markets in the first half of 2009. In particular, the company was withdrawing oil products from circulation, which resulted in increased prices. Also the company created discriminatory conditions for independent market participants. For those violations "ТNК-ВР Holding" OJSC was fined 4.19 billion Rubles.

Alongside with that, in June 2009 the Moscow Arbitration Court confirmed validity of the FAS Russia's claims against the group of persons of "Lukoil" OJSC being part of the first series of cases against oil companies.
