OREANDA-NEWS. January 26, 2010. The Federal Antimonopoly Service (FAS Russia) found that "TechnoNIKOL - Stroitel'nie Sistemy" Ltd. violated Part 3 Article 11 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.

The case was initiated upon the findings of a scheduled inspection carried by FAS Russia in 2009.

"TechnoNIKOL - Stroitel'nie Sistemy" Ltd. dominates the market of roll, roofing and waterproof materials within the boundaries of the Russian Federation and sells its products through its own trade network or through dealers.

According to the information received from the dealers, "TechnoNIKOL - Stroitel'nie Sistemy" Ltd. applied the so-called Rules for the Work with Dealers, that restricted the number of dealers and sub-dealers in the regions and fixed reselling prices for the materials. Dealers who failed to observe the prices recommended by the company could be held financially responsible.

"FAS Russia will continue investigating possible collusion between "TechnoNIKOL - Stroitel'nie Sistemy" Ltd. and its dealers. The case file will be transferred to the FAS Russia's Cartel Department", said Andrey Tsyganov, Deputy Head of FAS Russia.

Part 3 Article 11 of the Federal Law "On Protection of Competition" prohibits coordination of economic activity of market participants if such coordination leads or can lead to fixing or maintaining prices (rates), discounts, mark-ups, surcharges.
