OREANDA-NEWS. April 21, 2010. The Federal Antimonopoly Service (FAS Russia) found that the Institute of Program Systems, of the Russian Academy of Science, violated Part 1 Article 17 of the Federal Law "On Protection of Competition" (prohibiting competition-restricting actions in tenders), reported the press-centre of FAS Russia.

FAS Russia discovered that the violation was committed at a tender for developing a prototype of SKIF supercomputer (4th series), and supplying special equipment for it.

Investigating the documents presented by the party, FAS Russia discovered the employees of the ordering party (the Institute of Program Systems) at the same time work for "RSK SKIF" CJSC - the only bidder and winner of the tender.

Clause 4 Part 1 Article 17 of the Federal Law "On Protection of Competition" prohibits participation of the tender organizers or ordering parities and (or employees of the tender organizer or employees of the ordering parties in tenders. Violating the rules established by Article 17 constitute the grounds for a court of law to invalidate such tenders and transactions concluded upon the outcome of such tenders, in particular, upon a lawsuit of an antimonopoly body.
