OREANDA-NEWS. May 06, 2010. The Federal Arbitration Court of the Moscow District confirmed legitimacy of the decision and determination issued by the Federal Antimonopoly Service (FAS Russia) regarding "Voskresensk Mineral Fertilizers" OJSC, reported the press-centre of FAS Russia.

In April 2009, FAS Russia established that "Voskresensk Mineral Fertilizers" OJSC abused market dominance. In 2008 the company refused to supply sulphate-free phosphoric acid to "Voskresensk Research Institute of Fertilizers and Phosphoric Acid" OJSC without any economic or technological grounds (in breach of Article 10 of the Federal Law "On Protection of Competition").

Having analyzed the market of sulphate-free phosphoric acid, FAS Rusisa established that "Voskresensk Mineral Fertilizers" OJSC has dominant position on the relevant goods market.

Until August 2008 "Voskresensk Mineral Fertilizers" OJSC supplied sulphate-free phosphoric acid to "Voskresensk Research Institute of Fertilizers and Phosphoric Acid" OJSC, which used it to produce several refined phosphoric acids.

In August 2008 "Voskresensk Mineral Fertilizers" OJSC unilaterally terminated supplies of phosphoric acid to the Research Institute, which violated the antimonopoly law.

For violating the antimonopoly law FAS Russia fined the company 1,541,304 Rubles.

"Voskresensk Mineral Fertilizers" OJSC disagrees with the decision and determination issued by the antimonopoly authority and filed a lawsuit. The Courts of three instances confirmed legitimacy of the conclusions made by the Antimonopoly Service.
