OREANDA-NEWS. May 13, 2010. The 9th Arbitration Appeal Court confirmed validity of the decision made by the Moscow Office of the Federal Antimonopoly Service (the Moscow OFAS Russia) regarding "AKADO-Stolitsa" CJSC. Earlier the Court of First Instance arrived to the similar conclusions. Actions undertaken by the company could have restricted competition on the relevant market of communication services in the South-East Administrative District of Moscow, reported the press-centre of FAS Russia.

The Commission of the Moscow OFAS Russia found that "AKADO-Stolitsa" CJSC violated Part 1 Article 10 of the Federal Law "On Protection of Competition". The company abused its dominant position on the market of communication services for conveying signals from a free-access channel to user equipment in the South-East Administrative District of Moscow by fixing and maintaining monopolistically low price for technical support of subscribers' lines.

Such actions could have restricted competition on the relevant market by reducing the number of market participants.

"Quite often economic entities operating on the markets tend to dominate them.. Our job is to watch that their actions do not restrict competition and infringe consumer interests", said Vladimir Yefimov, the Head of the Moscow OFAS Russia. It is important that the Courts confirm our position because violations related to fixing monopolistically high or low prices do considerable damage to the national economy".
