OREANDA-NEWS. May 17, 2010. To execute Parts 3.1-3.3 Article 14 of the Federal Law "On Advertising", FAS Russia requested from Roscomnadzor (the Federal Agency for Control over Information Technologies and Communications) the list of organizations broadcasting in more than five constituent territories of the Russian Federation on the basis of licences. According to the information provided by Roscomnadzor, there are 11 such TV channels (as of 1st March 2010), reported the press-centre of FAS Russia.

To obtain a more precise list of federal channels, FAS Russia put an additional request to Roscomnadzor for information regarding organizations that otherwise broadcast in more than five constituent territories of the Russian Federation (on the basis of licence agreements, contracts, etc.).

Roscomnadzor added four federal TV channels to the earlier list - "TNT", "REN", "Mir" and "NTK Zvezda", and supplied this information the FAS Russia.

Therefore, as of 1st May 2010 the federal channels include:

2) "VGRTK" Federal State Unitary Enterprise" ("Russian Television", "Russia 2", "Russian Information Channel" ("RIK"), "Culture" National State Television Channel");

3) "Petersburg" Television and Radio Broadcasting Company" OJSC ("Petersburg 5th Channel");

4) "NTV Television Company" OJSC ("NTV Television Company");

5) "ТV Centre" OJSC ("TV Centre - Moscow");

6) "STS-Region" CJSC ("1st Entertainment STS", "Home");

7) "TV DARYAL" CJSC ("TV DARYAL");

8) "ТV service" CJSC ("МУUZ - ТV");

9) "7ТV Sport Channel" Ltd. ("7ТV");

10) "TV3 Television Channel" Ltd. ("TV-3 Russia");

11) "Energia TV" CJSC (MTV: Music Television");

12) "TNT-Teleset" OJSC;

13) "Aktsept" Ltd. (REN-TV TV channel) ("REN");

14) "Mir" Interstate Television and Radio Broadcasting Company" CJSC ("Mir");

3.1. Federal television channels cannot enter into contracts for providing advertising dissemination services with a person that has a dominant position in the field of disseminating television advertisements. For the purposes of this Article a federal television channel means an organization broadcasting in more than five constituent territories of the Russian Federation.

3.2. A dominant position of a person in the field of disseminating television advertisements on federal TV channels is recognized a position of a person whose share in this field exceeds 35% of national or regional dissemination. The person's share in the field of disseminating television advertisements is defined as the ratio of monetary funds received from the advertisers under the contracts for providing the services for disseminating advertisements on federal TV channels, concluded by the person and its affiliated persons, to the monetary funds received from advertisers under the contracts for disseminating advertisements on all federal TV channels. Monetary funds received from advertisers under the contracts for providing services for disseminating advertising are counted for two years proceeding the year when each such contract is concluded for the subsequent period.

3.3. Government-sponsored contracts for providing the services for disseminating TV advertisements on federal TV channels with are to be concluded on the basis of competitive bidding (auctions or tenders) organized by the above TV channels in accordance with the laws of the Russian Federation. The form of competitive bidding (auction or tender) is established by the federal TV channels.
