OREANDA-NEWS. May 25, 2010. The 19th Arbitration Appeal Court upheld the judgment of the Voronezh Regional Arbitration Court, dismissed the claim of "CentreTelecom" OJSC on invalidating the decision and determinations of the Voronezh Office of the Federal Antimonopoly service (the Voronezh OFAS Russia), reported the press-centre of FAS Russia.

Earlier the Voronezh OFAS Russia investigated a petition of "Kodotel" CJSC and found that "CentreTelecom" OJSC violated Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing market dominance).

"CentreTelecom" OJSC violated the law by terminating, without any economic reasons, services to "Kodotel" CJSC for transmitting traffic with A-numbers, different from the numbers reserved for the petitioner, from its network.

Such actions of the provider ("CentreTelecom" OJSC), that has dominant position on the relevant market, did not allow connected providers to honour their contract obligations for telecommunication services, which not only caused them direct financial losses (around 2 million Rubles per month) but also damaged their business reputation. At the same time, these actions deprived subscribers of a possibility to be rendered services of proper quality.

The Voronezh OFAS Russia simultaneously issued four determinations to "CentreTelecom" OJSC requesting the company to stop abusing market dominance and exercise actions aimed at protecting competition and preventing actions that can lead to restricting or eliminating competition and violating the antimonopoly law.

The 19th Arbitration Appeal Court confirmed validity of decision and determinations issued by the Voronezh OFAS Russia regarding "CentreTelecom" OJSC.
