OREANDA-NEWS. June 01, 2010. The Federal Antimonopoly Service (FAS Russia) is preparing a draft federal law "On General Principles of Organizing Public Control and Supervision in the Russian Federation". The project is being completed within No.1 Working Group at the Government Commission on Administrative Reform, led by Deputy Chairman of the RF Government and the Chief of Staff, Sergey Sobyanin, reported the press-centre of FAS Russia.

At the Working Group the draft law was discussed with representatives of business community, the authorities and professional associations.

"It's a long overdue necessity to introduce unified principles for organization and exercise of public control and supervision by federal and regional executive bodies. These principles must become fundamental for executing the state function of control and supervision in all regulated spheres", said the Head of FAS Igor Artemyev.

According to the draft law, to be efficient any state control and supervision must be based on a sufficient list of procedures, tools, rights and obligations. For instance, an investigation - in order to objectively confirm the signs of violations; initiating the case; establishing cases to be considered by a Commission; and decision-making - to ensure transparency and publicity, and eliminate the elements of corruption.

Efficient control requires sanctions proportionate to the social danger of a revealed violation as well as proportionate liability of enforcement bodies and persons for violating the legislation in course of exercising enforcement and control functions and inflicting damages upon the object of enforcement by their actions, and a responsibility to guarantee compensation of damages.

In the opinion of the authors of the draft law, excessive government regulation would be eliminated by excluding inspections of the same requirements by different controlling agencies, as well as establishing an exhaustive list of grounds for initiating and terminating control and supervision procedures.

FAS Russia's position is that public control and regulation should be free-of-charge (except special cases provided for by the federal legislation).

According to the Head of FAS Igor Artemyev, "only systemic approach to organization and procedures for exercising control-and-supervision functions by executive bodies leads to interfacing the interests of the state, the society and individual citizens".
